Information on the Right of Withdrawal
1. Right of Withdrawal for Consumers Consumers within the meaning of Section 13 of the German Civil Code (BGB) are natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. Such consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Nakaryu GmbH, Franz-Liszt str. 3 , 90571 Schwaig, Germany, E-mail: info@nekodanshi.de) by means of a clear statement (e.g. by letter or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.
2. Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for this repayment.
If you requested that the services begin during the withdrawal period, you shall pay us an appropriate amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, in comparison with the total scope of the services provided for in the contract.
3. Exclusion of the Right of Withdrawal The right of withdrawal does not apply to the following contracts:
- Contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
- Contracts for the supply of digital content not supplied on a tangible medium if the consumer has expressly consented to the commencement of performance of the contract before the expiry of the withdrawal period and has acknowledged that by giving consent they lose their right of withdrawal once performance has begun.
- Services that have already been fully performed if the consumer expressly agreed before placing the order that the service should begin immediately and they lose their right of withdrawal.
